Santa Clara is a county of moderate prices and considerable availability for liquor licenses. If you are intending on purchasing a license here expect to still deal with the hardships of other counties and to still drop a considerable chunk of change, but less so relative to counties like San Francisco.  The page below contains a plethora of information that will help you to learn about licensure in Santa Clara.

Moratorium

Moratorium denotes whether or not a business can obtain a liquor license from the state without the need for purchasing on the open market.  Counties with moratorium require that licenses are purchased rather than issued.  Santa Clara is a county without moratorium, but certain cities within the county still have moratorium. In Santa Clara the cities with moratorium are Campbell, Gilroy, Los Gatos, and Morgan Hill.

Types of Santa Clara County Liquor Licenses

The types of liquor licenses in Santa Clara parallel those of every other county in California.  As noted before, because of the lack of moratorium in a good number of states, people looking to get licensed in Santa Clara have the added benefit of more state issued options.  Regardless of moratorium, it is still not possible to get a direct issue full liquor license.  For all full liquor licenses on-sale or off you will need to go to the open market.

Type 20 Off-Sale Beer and Wine

Allows businesses to sell beer and wine to consumers who plan on drinking at home. With this type of license you can not serve customers drinks on premise and all alcohol must come in an original container. Depending on the city you are in, reference above, you may be able to acquire this license from the government directly.

Type 21 Off-Sale Full Liquor

Type 21 licenses are the big brother to type 20 licenses. They allow owners to sell all types of alcohol to patrons who are looking to drink at home or off-site.  This type of license must be acquired via some one selling, then transferred.

Type 41 Original Beer and Wine

Original beer and wine licenses are just that, original from the state.  No matter the county you do not need to buy this type of license from another person.  You do, however, need to go through the ABC application process, which can be equated to waiting in line at the DMV for 90 days with no guarantee your name will be called.

Type 47 Full Liquor Restaurant

Type 47 licenses are the little brother of the type 48 license.  They allow all types of alcohol to be sold if, and only if, food sales exceed sales of alcohol. You need to buy one to get one. Can be converted to a type 48.

Type 48 Full Liquor Bar

Type 48 licenses, the big bad brother of the type 47, allows buyers to sell alcohol with no food.  This is a bar license, its not easy to get approved for but it is highly touted and is convertible back and forth to a type 47. Must be bought on the open market.

Type 57 Full Liquor Private Club

Same rules as the 47, only you must charge patrons a fee for membership. it is best used for golf clubs and the like.

03 Open an escrow

Escrows are required for all liquor license transfers in California.  Escrow companies are among the most highly regulated companies in the United States.  They are audited regularly and must operate based on a firm set of guidelines.  Escrow companies have little to no power in the transfer process.  Make sure your escrow officers know the ins and outs of liquor license escrows.

04 Have the entire premises surveyed.
05 Submit your application

All potential licensees must submit their application through their local ABC office prior to getting their license.  Get a consultant to do the waiting and paper work for you, in the long run the extra money will save you time and energy.

06 Post a notice issued to you by the ABC on your premises for thirty days

Posting notices notify the public that alcohol will be sold at your establishment.

07 After the public notice period, the ABC will conduct an investigation into the business
08 Receive a liquor license in the mail from the ABC
